10 th Circuit lifts Kansas stay… The 10th U.S. Circuit Court of Appeals on Friday lifted a court order that prohibited Kansas from enforcing a law that requires health care providers to report so-called “consensual” underage sex to authorities. http://www.kansas.com The Court ruled that although minors have a right to informational privacy, it doesn't exist for illegal sexual conduct. The opinion says that the state has a greater interest in enforcing its criminal laws, protecting the best interest of minors and promoting public health. The decision will be posted at http://pacer.ca10.uscourts.gov.
By definition, underage sex is not “consensual” because the entire point of age of consent laws is that below this age, a child cannot be deemed to have consented to sexual activity. Under Kansas law, sexual contact with or between children under 16 is a crime. The age of consent varies from state to state, but in not one instance is it less than 16. Age of consent laws are under attack by pedophiles and pedophile rights groups because they are the underlying basis for prosecuting child molesters in the United States. Without age of consent laws, prosecutors would have to prove that the sex acts were not consensual and many parents would not allow their children to endure the cross examinations that would follow. In July 2003, Kansas Attorney General Phill Kline http://www.ksag.org issued an opinion on the state's 1982 mandatory reporter law, requiring doctors, nurses, psychiatrists, social workers and others who work with minors to report suspected instances of underage sex, even if it involves willing partners of similar ages.
A Judicial Inquiry was launched and became public last year when abortion providers sued Kansas to block enforcement. vol3_iss12
Indiana Attorney General Steve Carter is pursuing similar cases. vol3_iss17 Last summer, we wrote to every Attorney General and asked what they are doing to enforce age of consent and mandatory reporting laws. With a federal appeals court now our on side, we will press prosecutors at every level to use every resource at their disposal to enforce these laws.
As the President noted last night, teen pregnancies have declined for 12 straight years, thanks in large part to abstinence education, and abortions are at a 30-year low. http://www.whitehouse.gov The Department of Health & Human Services estimates that as many as two-thirds of all teen births are fathered by adult men. http://www.mafamily.org Enforcement of age of consent laws is the only way we can achieve further reductions in teen pregnancy rates.

Acknowledging that no amount of money can make up for what sexual abuse victims lost, a judge approved a settlement of up to $85 million between the Roman Catholic Diocese of Covington and parishioners who were molested by clergy. http://news.yahoo.com Meanwhile, Colorado's three Roman Catholic Bishops issued a joint statement criticizing a measure that would lift the statute of limitations for child sexual abuse lawsuits for two years. http://www.thedenverchannel.com Three weeks ago, a Michigan bishop made headlines acknowledging his own abuse by a priest when calling on Ohio officials to extend that state’s statute of limitations on clergy abuse claims. vol4_iss2
An Ohio man has sued his former teacher for custody of their son, following an affair he had with the teacher when he was a 17-year-old high school special education student. http://abcnews.go.com The affair began after the teen won a “win a date with a teacher” contest at the school.
